Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Llamadas mobile application and related services (collectively, the "Services"). By creating an account, downloading the app, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Llamadas provides tools for small businesses to manage business calling and messaging, optional AI-assisted handling of inbound calls, and related business features (such as client and scheduling workflows). Features may vary by plan, platform, or region. The live product is delivered through our native mobile apps; this website is for information, support, and legal notices unless we offer additional web-based tools.
2. Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to use the Services. You are responsible for all activity under your account and for keeping your credentials secure. You may sign in using methods we support (such as email or third-party identity providers). You must provide accurate registration information and keep it up to date.
3. Subscriptions and billing
Paid features may be offered through in-app purchases or auto-renewing subscriptions processed by platform providers (for example Apple App Store or Google Play) or by our payment processor Stripe (for direct web checkout from inside the app). The price, billing period, and accepted payment methods are shown to you at checkout. Fees, renewal terms, and cancellation are governed by the applicable platform or checkout flow in addition to these Terms. Unless required by law or stated otherwise at purchase, fees are non-refundable.
3.1 Auto-renewing subscriptions (Apple App Store)
When you purchase an auto-renewing subscription through the iOS app, the following terms apply in addition to Apple's standard auto-renewing subscription disclosures:
- Title of subscription: Llamadas Monthly subscription, providing access to the Llamadas app features described on the in-app purchase screen.
- Length of subscription: One (1) month, billed monthly.
- Price: The price displayed on the in-app purchase screen at the time of purchase (localized to your App Store country and currency).
- Auto-renewal: Payment will be charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the renewal price disclosed at the time of purchase (or any updated price you have accepted).
- Manage or cancel: You can manage your subscription and turn off auto-renewal at any time after purchase by going to your Account Settings on the App Store. Cancellation of the current period is not available once the renewal has begun.
- Free trial: If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription, where applicable.

3.2 Auto-renewing subscriptions (Stripe web checkout)
When you purchase an auto-renewing subscription through our Stripe-hosted checkout (opened from inside the Llamadas app), the following terms apply in addition to the disclosures shown on the Stripe checkout page:
- Title of subscription: Llamadas Monthly subscription, providing access to the Llamadas app features described on the in-app subscription screen.
- Length of subscription: One (1) month, billed monthly.
- Price: The price displayed on the Stripe checkout page at the time of purchase, in U.S. dollars. Applicable taxes may be added by Stripe based on your billing address.
- Auto-renewal: Payment will be charged to the payment method you provided to Stripe at confirmation of purchase. The subscription automatically renews at the same price each billing period until you cancel.
- Renewal charge: Your payment method on file with Stripe will be charged at the start of each renewal period. If a renewal charge fails, Stripe will retry per its standard dunning rules and may notify you by email; if all retries fail, the subscription will be suspended or cancelled.
- Manage or cancel: You can manage your subscription, update your payment method, view invoices, or cancel at any time through Stripe's Billing Portal, which you reach from Settings → Manage Subscription inside the Llamadas app. You may also email us at team@llamadaspro.com to request cancellation. Cancellation takes effect at the end of the current paid period; you keep access until then.
- Account deletion: If you delete your Llamadas account while a Stripe subscription is active, the subscription will be cancelled immediately as part of the deletion flow and you will not be billed again. No prorated refund is issued for unused time in the current period unless required by law or granted at our discretion.
- Refunds: Fees are non-refundable except where required by law or expressly stated otherwise. To request a refund, contact us at team@llamadaspro.com.
Stripe's collection and processing of your payment information is governed by Stripe's privacy policy. Our handling of the limited billing-status data we receive from Stripe is described in our Privacy Policy.
4. Acceptable use
You agree not to:
- Use the Services for unlawful, fraudulent, harassing, or abusive purposes
- Send unsolicited or illegal communications, or violate telemarketing or messaging rules
- Attempt to disrupt, reverse engineer, or scrape the Services except as permitted by law
- Misrepresent your identity or your business, or use the Services in a way that harms others
Telephony and SMS are subject to carrier rules, registration requirements, and applicable law. You are responsible for compliance when using your business number and messaging features.
5. AI features
Optional AI-assisted features may process call audio or related text to generate responses or summaries. AI outputs may be imperfect. You are responsible for how you use AI features in your business and for reviewing important information. Do not rely on AI as a substitute for professional advice where required.
6. Third-party services
The Services rely on infrastructure and integrations operated by third parties (for example telecommunications, cloud hosting, authentication, analytics, and AI providers). Your use of those services may also be subject to their terms and privacy policies.
7. Intellectual property
Llamadas and its licensors own the Services, including software, branding, and content we provide. We grant you a limited, non-exclusive, non-transferable license to use the app for your internal business purposes according to these Terms. You retain rights in content you submit; you grant us the rights needed to operate and improve the Services.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ERROR-FREE OPERATION, OR THAT CALLS OR MESSAGES WILL ALWAYS BE DELIVERED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Llamadas AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.
10. Indemnity
You will defend and indemnify Llamadas and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
11. Termination
We may suspend or terminate access to the Services if you violate these Terms or if we need to do so for legal, security, or operational reasons. You may stop using the Services at any time. Provisions that by their nature should survive will survive termination.
12. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date. Material changes may require additional notice where required by law. Continued use after changes become effective constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules, except where mandatory consumer protections in your country of residence require otherwise. The parties agree that the state and federal courts located in San Francisco County, California will have exclusive jurisdiction over any dispute arising out of these Terms, subject to mandatory law in your jurisdiction.
14. Apple App Store — additional EULA terms (iOS users)
The following terms apply to your use of Llamadas on iOS devices and are required by Apple Inc. ("Apple") under its standard end user license agreement template. In the event of any conflict between these Terms and the Apple-required terms below as they apply to iOS use, the Apple-required terms below will control to the extent of the conflict.
- Acknowledgement. You acknowledge that these Terms are concluded between you and Llamadas only, and not with Apple. Llamadas (not Apple) is solely responsible for the Llamadas app and its content.
- Scope of license. The license granted to you for the Llamadas app is a limited, non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. Llamadas is solely responsible for providing any maintenance and support services with respect to the Llamadas app, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to provide any maintenance and support services with respect to the app.
- Warranty. Llamadas is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Llamadas's sole responsibility.
- Product claims. Llamadas, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of health or fitness frameworks where applicable.
- Intellectual property rights. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Llamadas, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, or claims related to the app should be directed to: Llamadas, team@llamadaspro.com.
- Third-party terms of agreement. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
- Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
